Some kids making their way through Indiana’s juvenile justice system are slipping through the cracks. They’re supposed to get a public defender to help with their cases, but that doesn’t always happen.

So, some of them end up in the Department of Correction when they shouldn’t. And, oftentimes, it’s for an incident an adult would never serve time in prison for.

Most people facing criminal charges in Indiana can await their trials outside of jail – if they have the ability to post bail. Indiana’s Constitution defines bail as monetary, but a state Supreme Court rule will move away from that longstanding practice and allow counties to release some people without requiring a bail payment.
